General terms and conditions of use These terms of use apply to users of the mobile application cworc app and its connected web applications and to users of all other services, products or content in connection with the cworc App of cworc GmbH, Prinzessinnenstr. 8-14, 10969 Berlin, hereinafter referred to as "provider". By using or accessing, via a computer, mobile phone or any other electronic device, the cworc app or the Website, including the mobile version of the Website, or any product, content or other service made available by the Provider , you hereby agree to these Terms and any additional third-party terms specified in these Terms or in any other document made available in the cworc app or Website.

Definitions and Interpretations

In these Terms, unless the context otherwise requires, the following is defined:

Account Information Services or AIS: an online service providing consolidated information about one or more payment accounts of a payment service user with one or more other payment service providers.

API means Application Programming Interface - a set of functions and techniques that allow the creation of applications that access the functions, data or content of an operating system, application or other service provided by a third party.

cworc app means an app created by the Provider to record and share with authorized third parties the User's income and expenses and other financial or non-financial records or content of the User's choice. cworc app is intended for use by companies, i.e. legal entities, freelancers, tax consultants and accountants. cworc app is available for devices with the iOS operating system. Via the cworc app you can give the provider your consent to access information about your payment account from a third party who manages your payment account. The use of the cworc app is defined in these conditions as published by the provider and accepted by the user with the installation of the cworc app.

cworc App means an App created by the Provider to record and share with Authorized Third Parties the User's income and expenses and other financial or non-financial records or content of the User's choice. cworc App is intended for use by businesses, i.e. legal entities, freelancers, tax advisors and accountants. cworc App is available for devices with iOS operating system. Through the cworc App, you can give your consent to the provider to access information about your payment account from a third party that manages your payment account. The use of the cworc App is defined in these Terms, as issued by the Provider and accepted by the User upon installation of the cworc App.

Contract means an agreement made between the Provider and the User for the use of an app and/or the provision of Services according to these Terms.

Free features means a basic set of services that are available free of charge in an app.

Premium Features are additional services that provide additional value to certain users and are accessible during the trial period or via an in-app purchase. This feature set is not final as the provider may add or remove premium features at any time.

Registration means the process of entering the User's identification data into the registration form on the Website or in the cworc app and confirming the sending of the form to the Provider.

cworc app means a program (an application) created by the Provider to record, share and manage the User's income and expenses and other financial or non-financial records or content of the User's choice. The cworc app is intended to be used by natural and legal persons. The cworc app is available for download as an app for devices running on Android and iOS systems. The purpose of the cworc app is to track the user's expenses and income. You can use the cworc app to give the provider permission to request information about your payment account from a third party that manages your payment account or provides the technical infrastructure for it. The use of the cworc app is defined in these terms, issued by the provider and accepted by the user.

Website means a coherent group of pages that can be accessed at www.cworc.com on the World Wide Web and can be viewed as a single entity with specific content maintained by the Provider. Contract These conditions regulate the legal conditions and the relationship between the provider and the user. By installing the cworc app or by using the cworc app and the associated services, the user enters into a contract with the provider, the content of the contract including these conditions or related documents to which these conditions refer. By installing the cworc app or by using the related functions on the website, the user confirms

that he has read these conditions and will comply with them. Provider's failure or omission to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and Provider and govern your use of the cworc app as well the performance of the Services and supersedes all prior agreements between you and Provider, including but not limited to any prior versions of the Terms. Provider may change these Terms or the Privacy Policy from time to time. If the provider makes any material changes, they will notify you through their services or by email. If you do not agree to the changes, you can close your account at any time. If the User continues to use the Services after posting or sending a notice about the changes to the Terms, it means that the User agrees to the updated Terms. Registration and User Account The services can only be used after successful registration. The user acknowledges that the cworc app is not available without registration. Part of the registration is the provision of basic registration data about the user. This data can be provided in the registration form. The user is obliged to provide truthful information about himself. This also applies to data that the user provides by connecting the user account to another social network account. The user is responsible for keeping the login data and password for his user account secure and confidential. The Provider cannot and will not be liable for any loss or damage resulting from your failure to comply with this security obligation. To increase security, the provider recommends using PIN, fingerprint or Face ID protection for the user account. The provider assumes that all messages and inquiries that are entered directly from the environment of the cworc app or via the provider's website into the cworc app come from a registered user. For certain requests, the provider may request an email confirmation to ensure that the identity of the user is not compromised. The provider is entitled at any time to refuse the possibility of registering and creating a user account. Use of the cworc app and prohibitions You may only use the cworc app or the provider's website in accordance with these terms. You should not use the cworc app or the provider's website if the use could endanger your personal health or the health of others. Examples include walking in city traffic, working with hazardous machinery, working with electrical equipment, or driving a vehicle. The user is solely responsible for damage and loss resulting from improper use. You may not use the cworc app for any illegal or unauthorized purpose. You must not violate the laws applicable in your country by using the app. Including but not limited to copyright or trademark laws. Users may not, without written permission, modify or adapt the cworc app or change any other website in such a way as to give the false impression that it is connected to the cworc app, the website or other services of the Provider. You agree not to reproduce, duplicate, copy, resell or exploit any part of the cworc app and not to use or access the cworc app without the express written permission of the provider. Provider has the right, but has no obligation, to remove content and accounts containing content that it determines in its sole discretion to be unlawful, abusive, threatening, libelous, defamatory, or otherwise objectionable, or that violates any party's intellectual property or these Terms. Verbal, physical, written or other abuse, including threats of abuse or retaliation, by any customer, employee, member or officer of Provider will result in immediate account termination. You acknowledge that the technical processing and transmission of the Service, including Your Content, may be transmitted unencrypted and will involve (a) transmissions over various networks and (b) modifications to adapt to the technical requirements of connecting networks or devices. You may not upload, post, host or transmit unsolicited email, SMS or "spam" messages. You may not transmit any malware or viruses or any other destructive code. If your bandwidth usage significantly exceeds the average bandwidth usage determined solely by Provider than that of other customers of Provider, Provider reserves the right to disable your account immediately. Services and Prices The cworc app is aimed at users who track their records automatically and manually by entering their transactions in the app interface or by having the provider or a company affiliated with the provider read them in via an interface. The cworc app is not designed and cannot be used as a tool to accept or store money or money equivalents. The cworc app is not designed to carry out financial transactions or transfers. The interface feature allows users to import their transactions from their bank accounts by giving consent to the cworc app and providing their bank account credentials. This connection is read-only and the user's bank account details cannot be modified. The services are provided according to the so-called freemium model, in which a number of services are free of charge and allow the use of the cworc app to a certain extent that covers the basic needs of users. Services may differ for users of different app platforms - Android, iOS and desktop (website) - and are divided into free features and premium features. The provider has the right to extend or restrict the scope of the services at any time. Current and detailed information about the prices of the cworc app and the associated services are available at any time in your user account in the cworc app. By using the cworc app, additional costs, such as B. Fees for the Internet connection are incurred, which are to be borne by the user. Service and Pricing Changes The provider reserves the right to temporarily or permanently change or discontinue the cworc app or parts thereof at any time. Prices for all Premium Features, including but not limited to the monthly/annual subscription fees for the Premium Features, are subject to change without prior notice by the Provider. The change in prices will not affect the prices of premium features that you are already subscribed to. The Provider shall not be liable to you or any third party for any changes, price changes, suspension or discontinuation of the cworc app and/or related services. Third Party Services Users acknowledge that the Provider uses third-party providers and hosting partners to provide the necessary hardware, software, networks, storage and related technologies necessary for the operation of the cworc app and related applications. The cworc app uses third-party functions and services such as B.: AWS to host data, Salt Edge Inc. for connecting selected bank accounts including their end user license terms, Salt Edge Limited and using their partner program for access to Open Banking covered by your cworc Terms of Use and the cworc Privacy Policy will. By accepting these terms, the user acknowledges that the use of third-party services may be governed by their terms and conditions or privacy policies. The Provider has no or only limited control over the malfunction or interruption of third-party services and does not guarantee them. The provider is not liable for third-party services or third-party content. Please note that a third party that manages your payment account allows the provider to use their API so that the provider can access information about your payment account. Account Information Services Provided by Provider - Synchronization of Payment Accounts This section (Account Information Services) applies whenever you as a User request that the Provider provide you with Account Information Services (AIS) as further defined in the relevant Payments Regulations, in particular but not limited to the PSD2 and any law or regulation, which apply in each provider's jurisdiction and which give effect to the PSD2, regardless of which application you have used to request the provider to provide you with the AIS, e.g. through third-party APIs. The Vendor-provided AIS is designed to connect a user's bank account and receive automated imports of data and transactions performed by the user through their bank account or multiple bank accounts. This functionality is designed as read-only and the users cannot modify data (amounts, account names) retrieved from this source. The provider or its partners can only provide the AIS on the basis of your express consent, with which you allow the provider access to your respective payment account. You will be asked to give your consent in the cworc app. You can revoke this consent at any time within the cworc app. You can also inform the provider about the withdrawal of your consent by sending an email to the email address given below. You hereby acknowledge that the revocation/expiry of consent will not affect the actions of the Provider prior to the revocation/expiry. With your consent, the provider can also share your payment account data with the operator of the relevant app. This transfer takes place until your consent to the transfer of this data expires or is revoked by you or the operator of the respective app ends this transfer of its own accord. You will be prompted within the respective app to give your consent. You can revoke this consent at any time within the respective app. You can also inform the provider of the revocation of your consent by sending an email to the email address given below. You hereby acknowledge that the revocation/expiry of consent will not affect the actions of the Provider prior to the revocation/expiry. The Provider is subject to regulatory requirements (according to relevant European Union or local laws) in relation to anti-money laundering and countering the financing of terrorism and the related identity checks of our customers and monitoring of their status and transactions ("KYC"). In order to comply with the applicable regulations, cworc may request and store certain information from you, e.g. E.g. full name/legal entity name and legal form, date of birth/identification number, address of residence/registered office, type of payment account – separate, joint or legal – or public engagement. In certain circumstances, some additional information may be required, such as B. the ownership of payment accounts, the purpose of the transactions and the origin of the funds in your payment accounts. You undertake to provide accurate and up-to-date information deemed necessary for KYC purposes and acknowledge that failure to comply with KYC requirements may result in the Provider denying you AIS. By using the AIS offered by the Provider, you hereby confirm that you (i) are the legal holder of the relevant payment account and have the right to use the associated payment account details, or (ii) are duly authorized by the legal holder to access the payment account and use the personalized security credentials and associated payment account information. You are required to notify Provider and your applicable account provider immediately if you become aware of any loss, theft, or any unauthorized use or disclosure of your personal security information or payment account information. Provider reserves the right to deny you access to the AIS if Provider reasonably believes that there has been a loss, theft or unauthorized use or disclosure of the foregoing information. The AIS as such is provided by the provider free of charge. This is without prejudice to any fees for other services provided by the Provider or third parties operating the relevant apps. Please note that a third party that maintains your payment account allows the provider to use their API (Application Programming Interface) to allow the provider to access information about your payment account. You hereby acknowledge that special terms and conditions or privacy policies may apply to the use of such third-party services. In addition, the provider may use a third-party solution, such as that provided by Salt Edge Inc., to access information on your payment account. iOS platform Please note that the contract is between you and the provider and not with a third party, such as B. the Apple App Store, through which you made the purchase or download of the cworc app. Therefore, special conditions of these websites may apply to you. No app store is responsible for the cworc app and/or its content. The provider will take care of any problems or questions regarding the cworc app. This also applies to the service and maintenance of the cworc app. Any claim, whether by you or a third party, must be made directly to the Provider, who will have sole responsibility for handling such claims. The license granted to you is to use the cworc app as permitted by these terms and the terms of use of the respective app store. For example, Apple, Google Play and other app store providers and their affiliates and subsidiaries are third party beneficiaries under the terms of the Agreement. The App Store Providers and their affiliates and subsidiaries have the right to enforce any of these Terms against you by agreeing to these Terms. The stability and functionality of the app The Service is provided “as is and as available”. Provider does not warrant that (a) the Service will meet your specific requirements, (b) the Service will be uninterrupted, timely, secure or error-free, (c) the results that may be obtained from using the Service will be accurate or reliable , (d) the quality of any Services, information or other materials purchased or obtained through the Service will meet your expectations, or (e) any errors in the cworc app need to be corrected. There may be situations when the cworc app is temporarily unavailable in some of its parts or the service is interrupted for technical reasons. The stability and functionality of the cworc app service is not guaranteed. support and maintenance If you have any questions, you can reach the provider through the contacts provided in the Contacts section. Please note that support for the cworc app may be limited at times due to the provider's limited capacities. Permissions and Privacy Policy In order to access the functions of the cworc app such as e.g. B. taking or saving your pictures, geolocation services, synchronization of payment accounts, identity, contacts, WiFi connection or others, you must grant the provider the access rights required by the cworc app or by Google or Apple or a third party. This access is only used for the activities related to the functionality of the cworc App; some other information is scanned on your mobile device. You can manage your consent to permissions within the app and in your mobile device settings. You can find more information in the data protection declaration of cworc GmbH. If you do not agree to these permissions, the cworc app cannot display the desired functions if the permission is required. If you do not agree to these terms, you can delete your account at any time. We only process your personal data in order to be able to provide you with the service. You can find details on the processing of personal data in our data protection guidelines. User Account Terms Provider does not review User Content, but reserves the right to remove or block access to User Content for any reason. You are personally responsible for all content and activities that occur under your account. Even if the content is created and published by others whose accounts are shared under your main account. You may only use the cworc app if you are over 16 years old. By using the cworc app, you confirm that you are over 16 years of age and that you have read, understood and agree to these Terms. Cancellation and Termination Your account may be canceled at any time by sending a cancellation request to support@cworc.app. If you use the freemium model of the cworc app, all your content will be deleted from the cworc app within 5 working days in the event of such a termination. This process cannot be undone after your account has been canceled and the data has been deleted. If the Service is canceled prior to the end of your current payment period for a Premium Feature, your cancellation will be effective immediately. Refund policies are governed by the terms of service of each app store. Unless otherwise stated in the refund policy of the respective app store, refunds are generally not granted by the provider. License, Copyright and Use Rights for Content The provider does not claim any intellectual property rights to your content that you create while using the cworc app. You have the rights of use for your profile and the content you have uploaded. By using the release function to release your user account for others, you agree that others can see your content and, if necessary, obtain rights of use through additions. You indemnify Provider against any claim, demand, suit or proceeding brought by any third party against Provider alleging that your content or your use of the cworc app violates or misappropriates the intellectual property rights of third parties in breach of these Terms or violates applicable law. Likewise, you will indemnify Provider against all claims for damages and reasonable attorneys' fees Provider may incur in connection with any such claim, demand, suit or proceeding, provided that Provider promptly gives you written notice of such claim, demand, suit or proceeding. The Provider reserves all right and title, including all intellectual property rights, to the cworc app, the Website, the Services and the underlying technology, in particular - but not limited to - the design, the technical solutions, the content, the look and the Handling of the cworc app. Subject to your compliance with the Terms, Provider hereby grants you a limited, non-commercial, non-exclusive, non-transferable, revocable and non-sublicensable right to use the cworc app and all related services during the term of this Agreement and use in accordance with these Terms. The license is granted for your personal and non-commercial use only. You may only use the cworc app and related services for the purposes provided and permitted in these Terms. You may not rent, reproduce, copy, lease, sell, transfer, transfer, sublicense or reuse the cworc app or the cworc-related services, including any portion of the HTML/CSS, Java script or visual design elements or concepts without the express written permission of the provider. Limitation of Liability The use of the cworc app and/or the services is at your own risk. You expressly agree that Provider shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of arising from these Terms, the use of the cworc app and/or the Services or the actions of the Provider in connection with the Service. In particular, the Provider shall not be liable for any damage caused by (a) improper use of the Service; (b) the cost of procuring substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions completed through the Service; (c) unauthorized access to or alteration of your transmissions or data; or (d) statements or conduct of any third party on the Service. The total liability of the provider does not exceed the monthly price for the premium mode of the cworc app - regardless of whether the user pays the price or uses the freemium model of the cworc app. The foregoing limitation of liability applies to the maximum extent permitted by applicable law. Notwithstanding anything to the contrary in these Terms, Provider's liability in such cases shall be limited to the minimum extent permitted by law. You hereby agree and agree that the content of the cworc app and any related services does not constitute and should not be relied upon as financial, accounting, tax or other professional advice may. Final Provisions Changes or additions to this contract are only effective if they have been made in writing and have been mutually confirmed by the contracting parties. If the economic, technical, legal or competitive conditions on which the contract is based and on which the provisions of this contract are based change during the term of the contract and if the changes significantly affect the contractual relationship between the contracting parties, the contracting parties will discuss the consequences of a change with each other and adapt the contract to the changed circumstances. German law also applies exclusively to contracts with foreign contractual partners. The laws on international sales, in particular the UN Convention on Contracts for the International Sale of Goods, do not apply. Oral subsidiary agreements have not been made. Changes or additions as well as the termination or rescission of the contract must be made in writing in order to be effective, unless otherwise specified above. Contract

For certain requests, the Provider may require an email confirmation to ensure that the User's identity is not compromised. The provider is entitled to deny the possibility of registration and creation of a user account at any time.

Use of the cworc app and prohibitions

You may use the cworc App or the Provider's Website only in accordance with these Terms. You should not use the cworc App or the Provider's Website if using it could endanger your personal health or the health of others. Examples include walking in city traffic, working with dangerous machinery, working with electrical equipment, or driving a vehicle. The user is solely responsible for any damage or loss caused by improper use. You may not use the cworc app for illegal or unauthorized purposes. You must not violate any laws applicable in your country by using the App. Including, but not limited to, copyright or trademark laws. Users may not modify, adapt, or alter another website to falsely imply that it is affiliated with the cworc App, the Website, or other services of the Provider without written permission. You agree not to reproduce, duplicate, copy, resell or exploit any portion of the cworc App and not to use or access the cworc App without the express written permission of Provider. Provider shall have the right, but not the obligation, to remove any content and accounts containing content that Provider, in its sole discretion, deems unlawful, offensive, threatening, libelous, defamatory, or otherwise objectionable, or that violates any party's intellectual property or these Terms. Verbal, physical, written or other abuse, including threats of abuse or retaliation, of any customer, employee, member or officer of the Provider will result in termination of the account without notice. You acknowledge that technical processing and transmission of the Service, including Your Content, may be transmitted unencrypted and may involve (a) transmissions over different networks and (b) changes to accommodate technical requirements of connecting networks or devices. You may not upload, post, host or transmit unsolicited email, text messages or "spam" messages. You may not transmit malware or viruses or other destructive code. If your bandwidth usage significantly exceeds the average bandwidth usage, as determined solely by the Provider, of other customers of the Provider, the Provider reserves the right to immediately disable your account.

The cworc App is not designed and cannot be used as a tool to accept or store money or cash equivalents. The cworc App is not designed to conduct financial transactions or wire transfers. The interface feature allows users to import their transactions from their bank accounts by giving their consent to the cworc App and providing the appropriate login credentials for their bank account. This connection is read-only and the user's bank account data cannot be changed.
The services are provided according to the so-called freemium model, in which a number of services are free of charge and enable the use of the cworc app to a certain extent that covers the basic needs of the users. The services may be different for users of different app platforms - Android, iOS and desktop (website) and are divided into free features and premium features. The Provider has the right to expand or limit the scope of the Services at any time. Changes in the service and prices

The Provider reserves the right to modify or discontinue, temporarily or permanently, the cworc App or any part thereof at any time. Prices for all Premium Features, including but not limited to monthly/annual subscription fees for Premium Features, are subject to change without notice by Provider. The change in prices will not affect the prices of the Premium Features to which you are already subscribed. The Provider shall not be liable to you or any third party for any changes, price changes, suspensions or discontinuance of the cworc App and/or any related services.

Third party services

Users acknowledge that the Provider uses third party vendors and hosting partners to provide the necessary hardware, software, networks, storage and related technologies required to operate the cworc App and related applications. The cworc App uses third-party features and services such as: AWS to host data, Salt Edge Inc. to connect selected bank accounts including their end user license terms, Salt Edge Limited and use of their affiliate program to access Open Banking covered by your cworc Terms of Use and cworc Privacy Policy. By accepting these Terms, the User acknowledges that the use of third party services may be subject to their terms and conditions or privacy policies. The Provider has no or limited control over, and makes no warranty regarding, the malfunction or interruption of any third party services. Provider shall not be liable for any Third Party Services or any Third Party Content. Please note that a third party that manages Your Payment Account may allow Provider to use its API to allow Provider to access information about Your Payment Account.

This section (Account Information Services) applies whenever You, as a User, request that Provider provide You with Account Information Services (AIS) as further defined in the applicable payment regulations, including, but not limited to, PSD2 and any laws or regulations from time to time in effect in Provider's jurisdiction that give effect to PSD2, regardless of the application through which You have requested Provider to provide You with the AIS, such as through third-party APIs. The AIS provided by the Provider is designed to connect to a User's bank account and receive automated imports of data and transactions made by the User through their bank account(s). This functionality is designed to be read-only, and users cannot modify data (amounts, account names) retrieved from this source.
The Provider or its partners can only provide the AIS on the basis of your express consent, with which you allow the Provider to access your respective payment account. You will be prompted to give your consent in the cworc app. You can revoke this consent at any time within the cworc app. You can also inform the provider of the revocation of your consent by sending an email to the email address provided below. You hereby acknowledge that the revocation/expiration of consent will not affect the Provider's actions prior to the revocation/expiration.
The provider may also share your payment account data with the operator of the relevant app with your consent. This sharing will take place until the consent to share this data expires or is revoked by you or the operator of the respective app terminates this sharing of its own accord. You will be prompted to give your consent within the respective app. You can revoke this consent at any time within the respective app. You may also inform the provider of the revocation of your consent by sending an email to the email address provided below. You hereby acknowledge that the revocation/expiration of the consent has no effect on the actions of the Provider prior to the revocation/expiration.

The Provider is subject to regulatory requirements (under relevant European Union or local laws) relating to anti-money laundering and counter-terrorist financing and related identity checks of our customers and monitoring of their status and transactions ("KYC"). In order to comply with applicable regulations, cworc may require and retain certain information from you, for example, to identify the full name/legal entity name and legal form, date of birth/identification number, address of residence/registered place of business, type of payment account - own, joint or legal account - or public commitment. In certain circumstances, some additional information may be required, such as payment account ownership, the purpose of transactions, and the source of funds in your payment accounts. You agree to provide accurate and up-to-date information deemed necessary for KYC purposes and acknowledge that failure to comply with KYC requirements may result in the provider denying you AIS.
By using the AIS offered by the Provider, you hereby certify that you (i) are the rightful owner of the applicable Payment Account and have the right to use the related Payment Account Data, or (ii) are duly authorized by the rightful owner to access the Payment Account and use the Personalized Security Credentials and the related Payment Account Data. You shall notify Provider and your applicable account provider immediately if you become aware of any loss, theft, or unauthorized use or disclosure of your Personalized Security Credentials or Payment Account Data. The Provider reserves the right to deny you access to the AIS if the Provider reasonably believes that a loss, theft, or unauthorized use or disclosure of the foregoing information has occurred.
The AIS as such is provided by the provider free of charge. This is without prejudice to any charges for other services provided by the provider or third parties operating the relevant apps.
Please note that a third party that maintains your Payment Account may allow the Provider to use its API (Application Programming Interface) to allow the Provider to access information about your Payment Account. You hereby acknowledge that special terms and conditions or privacy policies may apply to the use of such third party services.
In addition, to access information on your payment account, the Provider may use a third-party solution, such as the one provided by Salt Edge Inc.

iOS platform

Please note that the contract is between you and the provider and not with a third party, such as the Apple App Store, through which you made the purchase or download of the cworc app. Therefore, special terms and conditions of these websites may apply to you. No App Store is responsible for the cworc App and/or its content. The provider will take care of any problems or questions regarding the cworc App. This also applies to the service and maintenance of the cworc App. Any claims, whether from you or a third party, must be directed to the Provider, who is solely responsible for handling such claims.
The license granted to you is to use the cworc App as permitted by these Terms and the Terms of Use of the applicable App Store.
Under the Terms, Apple, Google Play, and other app store providers and their affiliates and subsidiaries are third-party beneficiaries. The App Store Providers and their affiliates and subsidiaries, by agreeing to these Terms, have the right to enforce all of these Terms against you.

The stability and functionality of the app

The Service is provided "as is and as available".
Provider does not warrant that (a) the Service will meet your specific requirements, (b) the Service will be uninterrupted, timely, secure, or error-free, (c) the results that may be obtained from the use of the Service will be accurate or reliable, (d) the quality of any services, information, or other materials purchased or obtained by you through the Service will meet your expectations, or that (e) all errors in the cworc App will be correctable.
There may be situations when the cworc App is temporarily unavailable in some of its parts or the service is interrupted for technical reasons. The stability and functionality of the cworc App service is not guaranteed.

Support and maintenance
If you have any questions, you can reach the provider via the contacts provided in the Contacts section. Please note that support for the cworc app may be limited at times due to the provider's limited capacity.

Permissions and privacy policy

In order to access cworc App features such as taking or storing your pictures, geolocation services, payment account synchronization, identity, contacts, Wi-Fi connection, or others, you must grant the provider the access rights required by the cworc App or Google or Apple or a third party provider. This access will be used only for the activities related to the functionality of the cworc app; some other information will be scanned on your mobile device. You can manage your consent to permissions within the app and in your mobile device settings. For more information, please see the cworc GmbH privacy policy. If you do not agree to these permissions, the cworc app will not be able to display the desired features if the permission is required. If you do not agree with these conditions, you can delete your account at any time.
We process your personal data only to provide you with the service. Details about the processing of personal data can be found in our privacy policy.

User account conditions

The Provider does not review User Content, but reserves the right to remove or block access to User Content for any reason.
You are personally responsible for all content and activities performed under your account. Even if the content is created and published by others whose accounts are shared under your main account.
You may only use the cworc App if you are over 16 years old. By using the cworc App, you confirm that you are over 16 years old and that you have read, understood and agree to these Terms.

Cancellation and termination

Your account can be cancelled at any time by sending a cancellation request to support@cworc.app. If you are using the freemium model of the cworc app, all your content will be deleted from the cworc app within 5 business days upon such termination. This process cannot be reversed after your account has been cancelled and the data has been deleted.
If the service is cancelled before the end of your current payment period for a premium feature, your cancellation will take effect immediately. Refund policies are governed by the terms of use of the applicable App Store. Unless otherwise stated in the respective App Store's refund policy, refunds are generally not granted by the Provider.

License, copyright and rights of use for content

The provider does not claim any intellectual property rights to your content that you create while using the cworc app. You have the rights of use for your profile and the content you upload. By using the sharing function to share your account with others, you agree that others can view your content and, if necessary, obtain usage rights by adding to it. You indemnify the Provider against any claims, demands, actions or proceedings brought by third parties against the Provider alleging that Your Content or Your use of the cworc App infringes or misappropriates any third party's intellectual property rights or violates any applicable law in violation of these Terms. Likewise, you indemnify and hold harmless Provider from any and all claims for damages and reasonable attorneys' fees incurred by Provider in connection with any such claim, demand, action or proceeding, provided that Provider promptly notifies you in writing of such claim, demand, action or proceeding. Provider reserves all right and title, including all intellectual property rights, in and to the cworc App, the Website, the Services and the underlying technology, including but not limited to the design, technical solutions, content, look and feel of the cworc App. Subject to your compliance with the Terms, Provider hereby grants you a limited, non-commercial, non-exclusive, non-transferable, revocable and non-sublicensable right to use the cworc App and all related Services during the term of this Agreement and in accordance with these Terms. The license is granted only for Your personal and non-commercial use. You may use the cworc App and related services solely for the purposes contemplated and permitted by these Terms. You may not rent, reproduce, copy, lease, sell, transfer, sublicense or reuse the cworc App or the cworc related services, including any portion of the HTML/CSS, JavaScript or visual design elements or concepts without the express written permission of the Provider.

Limitation of liability

Your use of the cworc App and/or the Services is at your own risk. You expressly agree that Provider shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for lost profits, goodwill, use, data or other intangible losses, arising out of these Terms, use of the cworc App and/or the Services, or Provider's actions in connection with the Service. Specifically, Provider will not be liable for any damages caused by (a) your inappropriate use of the Service; (b) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or received or any messages received or transactions entered into through the Service; (c) unauthorized access to or alteration of any of your transmissions or data; or (d) statements or conduct of any third party on the Service. Provider's total liability will not exceed the monthly price for the premium mode of the cworc App - regardless of whether User pays the price or uses the freemium model of the cworc App.
The aforementioned limitation of liability shall apply to the maximum extent permitted by applicable law. Notwithstanding anything to the contrary in these Terms, the Provider's liability in such cases shall be limited to the smallest extent permitted by law. You hereby agree and acknowledge that the content of the cworc App and any related services does not constitute, and shall not be relied upon as, financial, accounting, tax or other professional advice.

Final provisions
Amendments or supplements to this contract shall only be effective if they have been drawn up in writing and mutually confirmed by the contracting parties. This shall also apply to any waiver or amendment of this written form clause. Should individual provisions of this contract be or become invalid or incomplete, this shall not affect the validity or completeness of the remainder of the contract. In place of the invalid or incomplete provision, the contracting parties shall agree on a provision that comes as close as possible in economic or legal terms to the purposes pursued by the contract and the intentions of the contracting parties in a legally permissible manner. If, during the term of the contract, the economic, technical, legal or competitive circumstances on which the provisions of this contract are based change and if the changes substantially affect the contractual relationship between the contracting parties, the contracting parties shall discuss the consequences of a change with each other and adapt the contract to the changed circumstances. German law shall also apply exclusively to contracts with foreign contractual partners. The laws on international sales, in particular the UN Convention on Contracts for the International Sale of Goods, shall not apply. Verbal subsidiary agreements have not been made. Amendments or supplements as well as the termination or cancellation of the contract must be made in writing to be effective, unless otherwise stipulated above. This written form requirement shall also apply to agreements regarding this written form clause. Contractual language is German. The place of jurisdiction is Berlin.
